Terms of Service

1. Agreement

By creating an account or using Cold Call.ai (the "Service"), you agree to these Terms. If you don't agree, don't use the Service.

2. Accounts

You must provide accurate information when creating an account and keep your credentials secure. You're responsible for activity that happens under your account.

3. Plans, billing, and limits

• Free accounts may use up to 10 AI practice calls per day at Beginner difficulty.
• Pro subscriptions include up to 25 AI practice calls per day, access to all difficulty levels, and advanced features. Subscription pricing is displayed during checkout and may change over time. Promotional, Founding Member, introductory, or discounted pricing may be offered for limited periods.
• Existing subscribers may retain promotional or grandfathered pricing where explicitly offered.
• Subscriptions renew automatically until cancelled. You can cancel anytime in Billing → Manage subscription; you keep Pro access until the end of the current billing period.
• Daily limits reset at midnight in the timezone set on your profile.
• Founding Member status is permanent and applies to anyone with an active Pro subscription before August 1, 2026.

4. Refunds

We offer a one-time refund for a user's first Pro subscription purchase if all of the following conditions are met:

• The refund request is submitted within 7 days of the initial charge.
• Fewer than 5 Pro practice calls have been completed.
• The account is in good standing and has not violated these Terms.

Refunds are not available for subscription renewals, partial billing periods, promotional periods already used, or accounts that exceed the usage threshold above.

Approved refunds will be returned to the original payment method.

5. Acceptable use

Don't use the Service to harass others, generate unlawful content, reverse engineer the platform, attempt to access another user's data, or resell access without our written permission.

6. Your content

You retain ownership of the pitches, briefings, and notes you provide. You grant us a limited license to process them to deliver the Service (including AI simulation and scoring) and to provide them back to you in your history.

7. AI output

AI responses and scorecards are generated automatically and may be inaccurate. Use your judgment — Cold Call.ai is a practice tool, not professional sales, legal, or business advice.

8. No guarantee of results

ColdCallerAI is a training and practice platform. We do not guarantee improved sales performance, increased revenue, appointment bookings, client acquisition, business growth, or any specific outcome from using the Service.

9. Disclaimers

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Service availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, upgrades, technical failures, third-party outages, security incidents, or circumstances beyond our control.

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim related to the Service is limited to the amount you paid us in the 3 months before the event giving rise to the claim.

12. Termination

We may suspend or terminate accounts that violate these Terms. You may close your account at any time by contacting support.

13. Changes

We may update these Terms occasionally. Continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by and interpreted under the laws of the State of Florida, without regard to conflict-of-law principles.

15. Dispute resolution

Before filing a legal claim, you agree to contact us and attempt to resolve the dispute informally. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Florida, and both parties consent to the jurisdiction of those courts.

ColdCallerAI is operated by Riques Web Design LLC, a Florida limited liability company.
